It becomes firm and final after: <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the Client\u2019s acceptance of these GTC;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">payment of the deposit provided for in Article 5 (or full payment when the booking is made less than 8 days before arrival);<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the booking confirmation sent to the Client by email by the Hosts.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Until these conditions are met, the booking request does not constitute a commitment and the dates may still be allocated to another Client.<\/span><\/p>\n<h3 style=\"font-family: 'parkinsans bold' !important\">Minimum length of stay<\/h3>\n<p><span style=\"font-weight: 400;\">The minimum length of stay is 2 nights.<\/span><\/p>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 4 \u2014 Prices, packages and services<\/h2>\n<p><span style=\"font-weight: 400;\">Prices are indicated in euros (\u20ac), per night and per accommodation, taxes included. They cover the services described at the time of booking. The applicable rates are those in force on the day of booking.  <\/span><\/p>\n<h3 style=\"font-family: 'parkinsans bold' !important\">Nightly rates<\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">El Sol (4 people): <span style=\"font-weight: 400;\">high season \u2014 Freedom \u20ac150 \/ Serenity \u20ac180; low season \u2014 Freedom \u20ac120 \/ Serenity \u20ac150.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">La Luna (2 people): <span style=\"font-weight: 400;\">high season \u2014 Freedom \u20ac125 \/ Serenity \u20ac155; low season \u2014 Freedom \u20ac90 \/ Serenity \u20ac120.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">High season: June 28 \u2013 August 31. Low season: the rest of the year (January 1 \u2013 June 27 and September 1 \u2013 December 31). <\/span><\/p>\n<h3 style=\"font-family: 'parkinsans bold' !important\">The two packages<\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Freedom package: <span style=\"font-weight: 400;\">self-catering accommodation. Breakfast optional at \u20ac12 per day, per person.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Serenity package: <span style=\"font-weight: 400;\">daily cleaning, beds made, breakfast and one complimentary experience (1 hour of Nordic walking or a photo outing in a Jeep).<\/span><\/li>\n<\/ul>\n<h3 style=\"font-family: 'parkinsans bold' !important\">Supplements and additional services<\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Pets: <span style=\"font-weight: 400;\">accepted, supplement of \u20ac8 per day, per animal. The La Luna studio is not enclosed by a gate, unlike El Sol.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Experiences (bookable separately): <span style=\"font-weight: 400;\">Nordic walking \/ hiking from \u20ac15; Jeep photo outing from \u20ac30; M\u00e1laga airport transfer \u20ac50. The information point is free and open to everyone.<\/span><\/li>\n<\/ul>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 5 \u2014 Payment terms<\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Deposit: <span style=\"font-weight: 400;\">a deposit of 50% of the total stay amount may be paid at the time of booking, failing payment of the full stay amount.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Balance: <span style=\"font-weight: 400;\">the balance must be paid on arrival, when the keys are handed over.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Accepted payment methods: <span style=\"font-weight: 400;\">payment on the website. Cash or cheque for the security deposit.<\/span><\/li>\n<\/ul>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 6 \u2014 Cancellation and changes<\/h2>\n<h3 style=\"font-family: 'parkinsans bold' !important\">Cancellation by the Client<\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">More than 16 days before arrival: <span style=\"font-weight: 400;\">free cancellation. Amounts paid (including the deposit) are refunded in full.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Between 15 and 8 days before arrival: <span style=\"font-weight: 400;\">50% of the amounts paid are refunded.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Less than 8 days before arrival: <span style=\"font-weight: 400;\">the full stay amount is due.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">No-show or early departure: <span style=\"font-weight: 400;\">the full stay amount is due.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Any request for changes (dates, accommodation, number of people) is subject to the Hosts\u2019 agreement and availability.<\/span><\/p>\n<h3 style=\"font-family: 'parkinsans bold' !important\">Cancellation by the Hosts<\/h3>\n<p><span style=\"font-weight: 400;\">In the event of cancellation by the Hosts, the amounts paid by the Client are refunded in full. Where possible, the Hosts will offer equivalent accommodation or alternative dates, without the Client being required to accept them. <\/span><\/p>\n<h3 style=\"font-family: 'parkinsans bold' !important\">No right of withdrawal<\/h3>\n<p><span style=\"font-weight: 400;\">In accordance with Article 103, paragraph l) of the consolidated text of the General Law for the Protection of Consumers (and Article 16 of Directive 2011\/83\/EU), accommodation services provided on a specific date or for a specific period do not benefit from the 14-day right of withdrawal. The applicable cancellation conditions are exclusively those set out in this article. <\/span><\/p>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 7 \u2014 Security deposit<\/h2>\n<p><span style=\"font-weight: 400;\">A security deposit of \u20ac500 per g\u00eete is required on arrival, by cheque or in cash. It is intended to cover any damage or exceptional cleaning. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is returned no later than within 48 hours after departure, less, where applicable, the cost of repairs or reinstatement noted and justified. An inventory of fixtures on arrival and departure may be drawn up jointly. <\/span><\/p>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 8 \u2014 Arrival, departure and key handover<\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Arrival: <span style=\"font-weight: 400;\">from 3:00 PM.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\">Departure: <span style=\"font-weight: 400;\">before 12:00 PM.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Any late or delayed arrival must be reported to the Hosts in advance. Living on site, the Hosts provide the welcome; adjusted times can be agreed together and may be subject to an additional charge. <\/span><\/p>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 9 \u2014 Traveller registration<\/h2>\n<p><span style=\"font-weight: 400;\">In accordance with Spanish regulations, the Hosts are required to provide the authorities (Guardia Civil \/ SES.Hospedajes platform) with the identity data of each traveller within the legal deadlines. On arrival, the Client and the accompanying adults undertake to present a valid identity document (ID card, passport or NIE) and to provide the information required for this mandatory registration. <\/span><\/p>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 10 \u2014 Occupancy and use of the premises<\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The number of occupants may not exceed the maximum capacity of the booked accommodation (El Sol: 4 people; La Luna: 4 people maximum). Any excess may result in refusal to accommodate additional people or termination of the stay. <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Client undertakes to occupy the premises peacefully, to respect the neighbourhood, the peace and quiet, the surrounding nature and the Hosts\u2019 eco-responsible approach.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The accommodation is rented for the exclusive use of holiday accommodation; any subletting or commercial activity is prohibited.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Client returns the accommodation in a reasonably clean and tidy condition.<\/span><\/li>\n<\/ul>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 11 \u2014 Liability and insurance<\/h2>\n<p><span style=\"font-weight: 400;\">The Client is responsible for any damage they cause during their stay. The Hosts cannot be held liable for loss, theft or damage to the Client\u2019s personal belongings, nor for inconveniences beyond their control (network outages, weather conditions, nearby public works, etc.). <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Hosts declare that they have taken out the civil liability insurance required to operate tourist accommodation in Andalusia. The Client is invited to check that they have civil liability insurance covering risks related to holiday rentals. <\/span><\/p>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 12 \u2014 Force majeure<\/h2>\n<p><span style=\"font-weight: 400;\">Neither party may be held liable for failure to fulfil its obligations resulting from a force majeure event (natural disaster, administrative decision, conflict, pandemic, etc.) making performance of the contract impossible. In such a case, the parties will seek a fair solution together (postponement or refund of amounts paid for the unperformed part). <\/span><\/p>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 13 \u2014 Complaints, mediation and disputes<\/h2>\n<p><span style=\"font-weight: 400;\">The Hosts make available to the Client the official complaint forms (hojas de reclamaciones) provided for by Andalusian regulations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the event of a dispute, the Client first contacts the Hosts to seek an amicable solution. Failing that, the Client may use the European Online Dispute Resolution platform: <\/span><a href=\"https:\/\/ec.europa.eu\/consumers\/odr\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">https:\/\/ec.europa.eu\/consumers\/odr<\/span><\/a><span style=\"font-weight: 400;\">, or the consumer services of the Junta de Andaluc\u00eda. The Hosts have not joined the Sistema Arbitral de Consumo.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These GTC are governed by Spanish law. Failing amicable resolution, the competent courts are those of M\u00e1laga, subject to mandatory rules protecting the consumer in their country of residence. <\/span><\/p>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 14 \u2014 Protection of personal data<\/h2>\n<p><span style=\"font-weight: 400;\">The Client\u2019s personal data is collected and processed by the Hosts, as data controllers, solely for the purposes of managing bookings, the relationship with the Client and compliance with their legal obligations (including traveller registration). It is not transferred to third parties for commercial purposes. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In accordance with Regulation (EU) 2016\/679 (GDPR) and the French Data Protection Act, the Client has the right to access, rectify, erase, restrict, object to and port their data, which they may exercise at contact@casita-sierramaris.com. They may lodge a complaint with the CNIL. Data processing is detailed in the Privacy Policy.  <\/span><\/p>\n<h2 style=\"font-family: 'parkinsans bold' !important\">Article 15 \u2014 Amendments to the GTC<\/h2>\n<p><span style=\"font-weight: 400;\">The Hosts reserve the right to amend these GTC at any time.
